These Terms of Service (“Terms”) govern your use of the MAH Haus Studios website (“Site”) and any purchase you make through the Site. By accessing the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.
1) Eligibility
You must be at least the age of majority in your jurisdiction (or use the Site under the supervision of a parent/guardian). You agree you will use the Site lawfully and not for any prohibited purpose.
2) Print-on-Demand Production
MAH Haus Studios products are made-to-order through a third-party production partner (Printify). By purchasing, you acknowledge:

Items are produced specifically for your order and may have minor variations in color, print placement, or texture compared to on-screen previews.

Production and delivery timelines may vary based on product type, print provider capacity, and carrier performance.
3) Orders, Pricing, and Payment

Prices are listed in U.S. dollars unless otherwise stated.

We may change prices, descriptions, or product availability at any time.

Your order is not accepted until payment is successfully processed.

We reserve the right to refuse, cancel, or limit any order for reasons including suspected fraud, pricing errors, inventory/production limitations, policy abuse, or operational risk.
4) Shipping, Delivery, and Address Accuracy

Estimated delivery dates are estimates, not guarantees.

Delays may occur due to production timelines, peak seasons, weather, carrier disruptions, or other events outside our control.

You are responsible for providing accurate shipping information. If an order is returned or delayed due to an incorrect address you entered, additional fees may apply to reship.
5) Refunds, Returns, and Replacements
Our Refund Policy is incorporated into these Terms by reference. Because items are made-to-order:

Most items are final sale.

We will replace or refund items that arrive damaged, defective, misprinted, or incorrect, provided you contact us within the timeframe in our Refund Policy and provide required documentation (including photos).
6) Cancellations and Changes
Orders begin processing quickly. Requests to cancel or modify an order must be submitted within 2 hours of purchase. After that, we may be unable to cancel or change an order once production begins.
7) Promotions, Discount Codes, and Gift Cards

Discount codes may not be combined unless explicitly stated.

Promotions may be modified or ended at any time.

Gift cards (if offered) are non-refundable except as required by law.
8) Intellectual Property
All content on the Site—including designs, graphics, logos, product images, text, and branding—is owned by MAH Haus Studios or licensed to MAH Haus Studios. You may not copy, reproduce, distribute, sell, or exploit Site content without written permission.
9) Acceptable Use
You agree not to:

Attempt to interfere with Site security or operations (hacking, scraping, introducing malware, etc.)

We may restrict or terminate access for violations.
10) User Content (Reviews, Comments, Submissions)
If you submit content (including reviews, comments, photos, or other materials), you represent you have the rights to do so and that your content does not violate any third-party rights or laws. You grant MAH Haus Studios a non-exclusive, worldwide, royalty-free license to use, display, reproduce, modify, and distribute your content for marketing, promotional, and operational purposes.
11) Third-Party Services
We use third-party providers to operate the Site and fulfill orders (including Shopify, Printify, payment processors, and shipping carriers). Your use of those services may be subject to their own terms. MAH Haus Studios is not responsible for third-party outages, disruptions, or delays.
12) Disclaimers
To the fullest extent permitted by law:

The Site, products, and services are provided “as is” and “as available.”

We do not guarantee uninterrupted or error-free Site operation.

Device screens may display colors differently; we do not guarantee exact color accuracy.
13) Limitation of Liability
To the fullest extent permitted by law, MAH Haus Studios will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of products.
In all events, MAH Haus Studios’ total liability for any claim will not exceed the amount you paid for the specific order giving rise to the claim.
14) Indemnification
You agree to indemnify and hold harmless MAH Haus Studios from claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or third-party rights.
15) Dispute Resolution and Arbitration (Texas)
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS.
A. Informal Resolution First
Before filing a claim, you agree to contact us at support@mahhausstudios.com and provide a brief description of the issue and your order number (if applicable). We’ll try to resolve disputes informally within a reasonable time.
B. Binding Arbitration
Except for claims that qualify for small claims court, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any purchase (“Dispute”) shall be resolved by binding individual arbitration and not in court.
C. No Class Actions
You and MAH Haus Studios agree that disputes will be arbitrated only on an individual basis. Class actions, class arbitrations, and representative actions are not permitted.
D. Small Claims Option
Either party may bring an eligible claim in small claims court in Texas (or the county where you reside, if allowed), instead of arbitration.
E. Arbitration Rules and Location
Arbitration will be conducted in English under applicable arbitration rules. Unless otherwise required, the arbitration will take place in Texas, or may be conducted remotely (video/phone) where appropriate.
16) Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Where arbitration does not apply, the parties agree that courts located in Texas will have jurisdiction and venue.
17) Changes to These Terms
We may update these Terms at any time. Updates are effective upon posting to the Site. Your continued use of the Site after updates means you accept the revised Terms.
